Fault finding: Protect your interests after a crash

After a car accident, determining fault is an important step. If you and the other driver don't agree on who is to blame and there is a question as to who caused the accident, you could find that you're placed at fault when you believe it was the other driver's fault completely. It's wise to do nothing that could suggest that you're taking responsibility following a crash. Don't admit to doing anything wrong, and don't apologize.

To determine fault, your insurance company needs to see a number of things, including evidence you've collected as well as police reports and medical documents. Evidence from the scene, like photos of skid marks or where the cars were impacted, can prove the angle of impact, speed and other facts of the case. Remember to gather information about the other driver and his or her insurance to provide this information to your attorney and insurance company.

If the other driver admits fault at the scene or apologizes for causing the accident, note that and make sure any attending police officer knows that as well. Normally, it's up to the authorities and your insurance provider to determine who's at fault, but if someone admits fault, he or she may be named as the person to blame regardless of the truth.
